Answer 1 :
Unfortunately, they can, and mostly at taxpayer expense. Because of a 2001 California law, illegal immigrants are charges average $12,000 per year (~$48,000 per undergrad degree) less tuition in state colleges than USA citizens and Green Card holders from other states. About 25,000 illegal immigrants attend California public colleges. Lower tuition paid by them costs the state ~$200 million per year. Put another way, tuition costs for legal residents are increased by $200 million per year to pay for the shortfall. It's a major scandal, and Obama hasn't said a word about California undermining federal immigration law, even though federal law prohibits education benefits for illegal immigrants.
Answer 2 :
Haven't heard any news regarding California lawmakers making a law saying they can't, so i guess they can. The schools might just classify them as international students, since they aren't legal residents.
Answer 3 :
i've heard people say they can
